TERMS AND CONDITIONS

Welcome to The Safety Pact. These Terms and Conditions (“Terms”) apply when you register for, attend, or purchase any of our workshops, online courses, or related services (collectively, the “Services”).

By registering online, signing in person, or making a purchase, you confirm that you have read, understood, and agree to be bound by these Terms.

In these Terms:

• “The Safety Pact”, “we”, “our” or “us” refers to The Safety Pact Pty Ltd (ABN 616 866 059 25);
• “you” or “the participant” refers to the person accessing or using our Services.

What We Do

The Safety Pact delivers personal safety and self-defence education. Our Services include both in-person workshops and online digital training focused on awareness, de-escalation, and physical self-defence techniques.

Scope of Services

These Terms cover all Services offered by The Safety Pact, including but not limited to:

In-Person Workshops: Face-to-face classes delivered at designated venues, covering topics such as situational awareness, psychological manipulation tactics, legal boundaries of self-defence, de-escalation techniques, and practical self-defence drills.
Online Courses:

Digital programs and learning modules delivered via our Platform, focusing on physical and psychological safety strategies, education, and personal security skills.

1 ELIGIBILITY AND PARTICIPATION
To register for and attend any In-Person Workshop, the following conditions must be met:

(a) You must be aged 18 years or over. If you are under 18, you may only attend with prior written consent from a parent or legal guardian;
(b) By registering, you confirm that you are medically and physically fit to participate and that you understand the inherent risks associated with physical training;
(c) You agree to disclose any pre-existing health conditions or concerns that may affect your ability to safely participate; and
(d) Participation is conditional on your prior acceptance and signing of our Waiver of Liability (Waiver).

2 PARTICIPANT’S OBLIGATIONS
2.1 LEGAL CAPACITY & AGE
You represent and warrant that:
(a) You have the legal capacity and are of sufficient age to enter into these Terms; or
(b) You are the parent or legal guardian of a participant under 18 and are providing consent on their behalf.

2.2 SAFETY, INSTRUCTIONS AND CONDUCT

You agree to:
(a) Follow all safety instructions, behavioural guidelines, and any other directions provided by The Safety Pact and its facilitators or Personnel.
(b) Cease participation immediately and notify a staff member if you feel faint, unwell, injured, or otherwise unsafe during a session; and
(c) Accept responsibility for your own health and conduct, and for the safety of any minor participant attending under your supervision and consent.

2.3 HEALTH & PARTICIPATION CONDITIONS
By participating in the In-Person Workshops, you warrant that:
(a) You are not pregnant and do not have any condition, injury, or illness (Condition) that increases the risk of harm to yourself or others during participation;
(b) You will notify The Safety Pact immediately if you develop a Condition after registering;
(c) You acknowledge that The Safety Pact may, at its discretion, restrict or refuse participation if a Condition is disclosed or suspected;
(d) You understand that even in the absence of accidents, physical activities carry an inherent risk to your health and wellbeing;
(e) You will not participate under the influence of alcohol, drugs, or prohibited substances; and
(f) You will not attend or participate in any In-Person Workshop if you are feeling unwell, injured, or otherwise medically compromised.

2.4 PERSONAL POSSESSIONS
You are solely responsible for your personal belongings during your attendance at any premises where In-Person Workshops are held (Premises). The Safety Pact accepts no liability for any loss, theft, or damage to your personal property.

3 FEES & PAYMENT
(a) The fees payable for our Services, including In-Person Workshops and Online Courses, are as stated at the time of booking or purchase. Unless specifically stated otherwise, all prices are listed in Australian Dollars (AUD) and may include GST where applicable.
(b) The Safety Pact reserves the right to change pricing at any time, but such changes will not affect services already purchased or booked.
(c) Full payment must be made in advance through our approved payment platform. We do not offer payment plans or instalments unless expressly stated.

4 THIRD PARTY SERVICES & PRODUCTS
(a) The Safety Pact may engage third-party providers to deliver certain services, including but not limited to payment processing, video hosting, event facilities, and instructional support.
(b) You acknowledge that your use of such third-party services may be subject to their own terms and conditions, privacy policies, or disclaimers, and you agree to comply with them where applicable.
(c) We do not control, endorse, or assume responsibility for any third-party content, systems, or performance. Your dealings with third-party providers are solely between you and them.
(d) To the extent permitted by law, The Safety Pact disclaims all liability for loss, damage, or disruption arising from your use of, or reliance on, any third-party goods or services, even if they are recommended, facilitated, or linked through our website or programs.

5 ACKNOWLEDGEMENT OF RISK AND PHYSICAL PARTICIPATION
(a) You acknowledge that the In-Person Workshops delivered by The Safety Pact involve physical activity, including but not limited to simulated self-defence techniques, partner drills, and de-escalation practice scenarios.
(b) While all reasonable steps are taken to provide a safe environment, you understand and accept that engaging in physical self-defence training carries inherent risks, including but not limited to bruises, muscle strain, or more serious injury.
(c) By enrolling in a class, you confirm that you are physically and medically fit to participate and are solely responsible for managing any pre-existing conditions.
(d) You are required to sign a separate Waiver of Liability form prior to attending any in-person event, and no participation will be permitted without a completed waiver.
(e) You will bear all risk of loss or destruction of, or damage to, any equipment and/or other property and/or people arising out or contributed to by your participation in the Services.

6 RESPONSIBLE USE OF SELF-DEFENCE TECHNIQUES
(a) The Safety Pact teaches techniques and strategies for personal safety and self-defence only. These are intended for lawful and defensive use in response to genuine threats.
(b) Participants agree not to apply or demonstrate these techniques in any aggressive, retaliatory, unlawful, or harmful manner.
(c) The Safety Pact accepts no responsibility or liability for the misuse of any technique or information taught during its programs.

7 USE OF THIRD-PARTY VENUES AND CO-FACILITATORS
(a) In-Person Workshops may be conducted at venues not owned or operated by The Safety Pact. While reasonable care is taken to select appropriate locations, The Safety Pact disclaims liability for any incident, injury, or inconvenience arising from venue conditions or third-party arrangements.
(b) Some workshops may involve qualified third-party instructors or guest facilitators. The Safety Pact will use reasonable efforts to ensure such individuals act professionally, but it is not responsible for the conduct or statements of independent facilitators.

8 LIABILITY AND INDEMNITIES

8.1 LEGAL DISCLAIMER & NO RELIANCE
(a) You acknowledge that in deciding to pay for the Services and agreeing to these Terms, you have not relied on the skill or judgment of The Safety Pact and that you have satisfied yourself as to the condition and suitability of the Services for your purpose.
(b) The Safety Pact does not provide legal advice. All legal references in our training are for general information only.
(c) You should seek your own legal counsel if you require advice specific to your situation.

8.2 LIABILITY.
(a) You acknowledge and agree that:
(i) participation in the In-Person Workshops involves interactions with other participants and may carry the risk of injury and other unpredictable risks; and
(ii) to the maximum extent permitted by law, you release The Safety Pact and its officers, employees and contractors, the organisers, sponsors, other participants, and any other persons involved in the participation of the Services from any demand, claim, or other proceeding in relation to any injury or death or loss or damage to personal property in connection with your participation in the Services.

(b) To the maximum extent permitted by law and subject to clause 8.2(c), the total liability of each party in respect of loss or damage sustained by the other party in connection with the Services and these Terms is limited to the amount paid by you to The Safety Pact in the 3 months preceding the date of the event giving rise to the relevant liability.

(c) Clause 8.2(b) does not apply to your liability in respect of loss or damage sustained by The Safety Pact arising from:
(i) your breach of these Terms;
(ii) any negligent, fraudulent or criminal act or omission of you; or
(iii) an event, where circumstances giving rise to a claim, were caused or contributed to by you.

8.3 CONSEQUENTIAL LOSS
To the maximum extent permitted by law, neither party will be liable for any incidental, special or consequential loss or damages, or damages for loss of data, business or business opportunity, goodwill, anticipated savings, profits or revenue in connection with this agreement or any goods or services provided by The Safety Pact, except:
(a) in relation to a party’s liability for fraud, personal injury, death or loss or damage to tangible property; or

(b) to the extent this liability cannot be excluded under the Competition and Consumer Act 2010 (Cth).

8.4 INDEMNITY
You indemnify The Safety Pact from and against all losses, claims, expenses, damages and liabilities (including any taxes, fees or costs) which arise out of:

(a) any breach of these Terms by you;
(b) any negligent, fraudulent or criminal act or omission by you; or
(c) an event, where circumstances giving rise to a claim, were caused or contributed to by you.

9 DISCLAIMERS

Subject to your Consumer Rights, we are not liable for any loss caused to you in connection with the non-provision of Services to you as a result of the suspension or cancellation of such Services or as a result of us changing the services we provide or no longer offering services in the exercise of our discretion.

10 CONFIDENTIALITY, PRIVACY & DISCLOSURE.
(a) We are committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth), where applicable, the GDPR for international users, and in accordance with our Privacy Policy as amended from time to time and which is available on our Website.
(b) Data collected during registration, participation or Website interaction is used to provide the Services or improve user experience.
(c) We will only disclose information that we have about you:
(i) to the extent specifically required or authorised by law; or
(ii) for the purpose of these Terms (including disclosing information in connection with any query or claim); or (iii) with your express written consent.

11 CANCELLATIONS & REFUNDS

11.1 BY THE SAFETY PACT.
We reserve the right to cancel or postpone an In-Person Workshop and/or Online Course to an alternative date(s). In this instance, all registered participants will be offered the opportunity to transfer to the next available In-Person Workshop and/or Online Course (as notified by us) or elect to receive a full refund for monies paid.

11.2 BY YOU
(a) In-Person Workshops: you may cancel up to 48 hours prior to the workshop to receive a full refund. Cancellations made within 48 hours of a scheduled workshop may be refunded at our sole discretion.
(b) Online Courses: No refunds will be issued once access to our Online Courses or digital products have been granted.

12 USE OF DIGITAL MATERIALS AND COURSE CONTENT.
(a) The Safety Pact grants you a limited, non-transferable, non-exclusive licence to access and view digital training content purchased via our Platform. (b) All content provided in our In-Person Workshops, Online Courses and any other services as offered from time to time remains the property of The Safety Pact. You must not copy, download, distribute, publish, modify, reverse-engineer, or create derivative works from any part of the online content without prior written consent.
(c) Breach of these Terms may result in suspension or termination of access without refund, and legal action may be pursued where appropriate.

13 ONLINE PLATFORM ACCESS AND USER ACCOUNTS
(a) Access to online training materials may be delivered via a secure Platform. You may be required to create an account and keep login credentials confidential.
(b) You are responsible for all activity that occurs under your account and must notify The Safety Pact immediately of any unauthorised use.
(c) The Safety Pact makes reasonable efforts to ensure the availability of online content but does not guarantee uninterrupted access and is not liable for disruptions caused by third-party service providers, internet outages, or maintenance.

14 PHOTOGRAPHY & FOOTAGE.
We may take photos or videos during In-Person Workshops or other events for promotional purposes. By attending, you grant permission for your image to be used unless you request otherwise in writing prior to the event.

15 DISPUTE RESOLUTION
(a) We aim to resolve all customer concerns quickly and fairly. If you have a complaint or issue, please contact us at [zingiris@thesafetypact.com] in the first instance.
(b) If we are unable to resolve your issue within 30 days, both parties agree to attempt to resolve the matter through mediation, administered in accordance with the Australian Disputes Centre (ADC) Guidelines.
(c) Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief through the courts if necessary to prevent immediate harm or to protect legal rights.

16 NOTICES
16.1 METHOD OF DELIVERY

(a) Any legal or formal notices required or permitted under these Terms must be delivered in writing by one of the following methods:
(i) Email (to the nominated email address of the receiving party); or
(ii) Through any in-platform messaging system The Safety Pact may establish for legal communication.

16.2 NOTICES TO THE SAFETY PACT

All notices to The Safety Pact must be addressed to

16.3 DEEMED RECEIPT
A notice is deemed to be received:
(a) If sent by email: at the time of sending, unless the sender receives a delivery failure notice;

16.4 UPDATES TO CONTACT DETAILS.
It is your responsibility to ensure The Safety Pact has your current contact details. Notices sent to the last provided contact details will be deemed properly served.

17 GENERAL.
17.1 GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria.

17.2 AMENDMENTS.
These Terms may only be amended in accordance with a written agreement between the parties.

17.3 WAIVER.
No party to these Terms may rely on the words or conduct of any other party as a waiver of any right unless the waiver is in writing and signed by the party granting the waiver.

17.4 SEVERANCE
Any term of these Terms which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity and enforceability of the remainder of these Terms is not limited or otherwise affected.

17.5 ASSIGNMENT
A party cannot assign, novate or otherwise transfer any of its rights or obligations under these Terms without the prior written consent of the other party.

17.6 ENTIRE AGREEMENT These Terms and the Waiver embodies the entire agreement between the parties and supersedes any prior negotiation, conduct, arrangement, understanding or agreement, express or implied, in relation to the subject matter of these Terms.


18 DEFINITIONS.
In addition to capitalised terms defined in the Terms above, capitalised words used in these Terms will have the following meanings:

Term and Meaning

Consumer Rights means your rights and remedies under the Australian Consumer Law (ACL) which by law cannot be excluded.
In-Person Workshops means in-person, physical self-defence classes hosted at the Premises, including education on situational awareness, de-escalation, psychological manipulation tactics, legal boundaries of self-defence, and physical techniques.
Laws mean any applicable statute, regulation, by-law, ordinance or subordinate legislation in force from time to time in the relevant jurisdiction(s) where the Services are performed or received and includes any industry codes of conduct.
Online Courses means our online digital programs and training modules available through our Platform centred on physical and psychological safety issues, education and competencies.
Personnel means, in respect of a party, that party’s officers, employees, contractors (including subcontractors) and agents.
Platform means our online, digital platform from where you can register for events, purchase and access our Online Courses or other digital offerings from time to time.
Premises means any physical location where the In-Person Workshops or other in-person events are held.
Services means our In-Person Workshops, Online Courses, and any other services we may offer from time to time.
Waiver means the Waiver of Liability at Appendix A to these Terms.


APPENDIX A – WAIVER

WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012
Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you-
• are rendered with due care and skill; and
• are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and
• might reasonably be expected to achieve any result you have made known to the supplier.
Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the supplier is entitled to ask you to agree that these statutory guarantees do not apply to you. If you sign this form, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the services provided were not in accordance with these guarantees, are excluded, restricted or modified in the way set out in this form.
NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.

THE SAFETY PACT WAIVER

1.0.You are requesting to participate in self-defence training and related activities (the Services) provided by The Safety Pact ABN 616 866 059 25, or by third parties engaged by The Safety Pact. This waiver and release form (Waiver) applies to your participation in those Services.

2.0. You understand and acknowledge that the Services, including but not limited to the provision of in-person self-defence workshops, as well as training, programs, and events held by The Safety Pact, may expose you to risk, including accidents, injury, illness or even death. You assume all risk of injuries associated with participation in the Services, including but not limited to, falls, contact with other participants or Personnel, equipment failure, risks inherent in martial arts Services, such as impact injuries, physical risks inherent in exercise, the effects of the weather, including high heat and/or humidity and the loss of your personal property and exclude The Safety Pact from liability.

3.0. Because physical exercise can be strenuous and subject you to risk of serious injury, The Safety Pact urges you to obtain a physical examination from a doctor before participating in any Services. You agree that when you engage in the Services, on the Premises or off the Premises, including at an event, you do so entirely at your own risk.

4.0. You warrant and represent that you have no injuries, physical restrictions, disabilities or predispositions to sickness or injury (Conditions) that may affect your participation in the Services or that if you are aware of such Conditions, you participate in any Services provided by The Safety Pact entirely at your own risk.

5.0. You exclude The Safety Pact and its officers, employees and contractors, the organisers, sponsors, other participants and any other persons involved in your participation in the Services with The Safety Pact (Releasees) from any demand, claim, or other proceeding in relation to any injury or death or loss or damage to personal property in connection with your participation in the Services with The Safety Pact, whether or not caused by the negligence of a Releasee.

6.0. You agree to indemnify each Releasee in relation to any demand, claim or proceeding that may be brought in connection with your participation in the Services with The Safety Pact where circumstances giving rise to such a demand, claim, or proceeding were caused or contributed to by you or your breach of these Terms.

7.0 You agree that should any part of these Terms and Waiver be found by a court of law to be against public policy or in violation of any state statute or case precedence, then only that wording is removed and the remainder of these Terms and Waiver will remain in full force.
